1. Introduction
These Terms and Conditions govern participation in motorcycle trips organized by Elevation Riders. By booking a trip, you acknowledge and agree to be bound by these terms and conditions. Elevation Riders reserves the right to modify these terms at any time, with changes effective upon posting on our website.
2. Definitions

Participant: Any individual who books a trip with Elevation Riders.

Operator: Elevation Riders and its authorized representatives.

Trip: Any motorcycle adventure organized by Elevation Riders, which may include accommodations, meals, guided services, and travel logistics as specified in the trip itinerary.
3. Assumption of Risk
Participants acknowledge that motorcycle travel involves inherent risks, including but not limited to injury, death, and property damage due to factors such as road conditions, terrain, weather, traffic, and wildlife. By participating in the trip, participants voluntarily assume these risks.
4. Booking and Payment

All bookings must be made through our website or designated contact points.

A non-refundable deposit of $1500 is required to secure your booking. This deposit confirms your reservation and commitment to the trip.

The remaining balance must be paid in full at least 30 days prior to the trip start date.

Accepted payment methods include credit card, PayPal, and bank transfer. Failure to pay the full balance by the due date may result in cancellation of the booking and forfeiture of the deposit.

Prices are per person and are inclusive of accommodations, meals, guided tours, and other services as specified. Costs such as fuel, personal expenses, and insurance may not be included unless stated otherwise.
5. Participant Responsibilities

Participants must be at least 18 years old and hold a valid motorcycle license.

Participants are required to wear appropriate safety gear as specified by Elevation Riders, including helmets, protective clothing, and footwear.

Participants are responsible for adhering to all instructions and safety guidelines provided by the Operator and are expected to exercise caution and respect for local customs and environments.

Participants must ensure they are physically and mentally fit for the demands of the trip, which may include high altitudes, extended periods of riding, and varied terrain.
6. Liability Waiver

All participants must sign a liability waiver prior to the trip, acknowledging the risks involved in motorcycle riding and agreeing not to hold Elevation Riders responsible for any injuries, damages, or losses that may occur during the trip.

Participants are responsible for any damages or losses caused to rented equipment or property provided by Elevation Riders.
7. Disclaimer of Warranties

Elevation Riders makes no warranties, express or implied, regarding the quality, fitness, or safety of the trip services provided. Participants participate at their own risk, acknowledging the inherent uncertainties of adventure travel.
8. Indemnification

Participants agree to indemnify, defend, and hold harmless Elevation Riders, its employees, agents, and affiliates from any claims, damages, losses, liabilities, or expenses arising out of or in connection with their participation in the trip, including any claims arising from their own negligence or failure to comply with safety guidelines.
9. Medical Disclosure and Emergency Medical Treatment

Participants must disclose any relevant medical conditions that could affect their ability to participate in the trip. Elevation Riders reserves the right to refuse participation if the medical condition poses an unreasonable risk to the participant or others.

By participating, participants consent to emergency medical treatment if deemed necessary by the Operator. Participants are responsible for any medical expenses incurred during the trip.
10. Insurance

Participants are strongly encouraged to obtain travel insurance that includes coverage for personal injury, trip cancellation, theft, loss of personal belongings, and third-party liability.

Participants must provide proof of insurance before the trip if required by the Operator. Failure to do so may result in cancellation of participation without refund.
11. Changes to Itinerary

Elevation Riders reserves the right to modify trip itineraries due to safety concerns, weather conditions, or other unforeseen circumstances. Significant changes to the itinerary will be communicated to participants as early as possible.

In cases of significant modification, participants may be offered alternative arrangements. If no suitable alternative is available, a partial refund may be provided at the Operator’s discretion.
12. Non-Transferable Bookings

Bookings are non-transferable and cannot be assigned to another person without the prior written consent of Elevation Riders.
13. Release of Image Rights

By participating in the trip, participants grant Elevation Riders the right to use any photos, videos, or recordings made during the trip for marketing and promotional purposes without additional compensation.
14. Dispute Resolution

Any disputes arising from these Terms and Conditions shall be governed by the laws of the State of Texas, USA.

Participants agree to first attempt to resolve any disputes through mediation before pursuing legal action. Mediation will take place in Texas or through a mutually agreed-upon online platform.
15. Privacy Policy

Elevation Riders is committed to protecting your privacy. Personal information collected during the booking process is used solely for trip management, communication, and customer service.

16. Force Majeure

Elevation Riders shall not be liable for failure to fulfill its obligations due to events beyond its control, including but not limited to natural disasters, war, pandemics, government restrictions, or other emergencies. In such cases, refunds may not be available; however, we will endeavor to reschedule or offer an alternative trip when feasible.
17. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
18. Entire Agreement

These Terms and Conditions constitute the entire agreement between the parties and supersede all prior communications, proposals, or understandings, whether oral or written.
19. Governing Law

These Terms and Conditions are governed by and construed under the laws of the State of Texas, USA. Any legal action arising from these terms shall be filed in the appropriate courts in Texas.
